Business that allowed land to become a dumping ground for rubbish is successfully prosecuted by Redbridge Council

A business owning land in the borough that became a local dumping ground for fly-tippers has been successfully prosecuted by Redbridge Council leading to hefty fines for both the business and its director.

The case ended up in court after the business, 105 Water Gardens Ltd, and its director Fahad Ahmed, aged 48, repeatedly failed to clear rubbish that had been dumped on unsecured company land in Balfour Road, Ilford. 

Their actions eventually led to both the company and Ahmed being handed court fines, and costs against them, together totalling more than £6000.

Redbridge Council’s Enforcement Officers were originally alerted to the eyesore site following public complaints concerning dumped furniture, mattresses, luggage and other rubbish, and the unsecured condition of the land.

A warning letter was initially given to the company instructing the privately owned site to be cleared and secured within seven days to deter further fly-tipping and anti-social behaviour. 

Returning two weeks later, Redbridge Enforcement Officers discovered the site in its original, untidy state and still unsecure. A Community Protection Notice (CPN) was issued, legally ordering the company to clear and secure the land within 10 days.

Despite the legal notice, the rubbish remained uncleared and the land unsecured, leading to three Fixed Penalty Notices being issued for failing to comply with the CPN. The penalties remained unpaid, resulting in court prosecution.

Both 105 Water Gardens Ltd and Ahmed were  summonsed to Barkingside Magistrates Court charged with three offences under S.48(1)Anti-social Behaviour Crime & Policing Act 2014.

Ahmed failed to attend court on Tuesday 5 August, and the case was heard in his absence. The Magistrates found all charges proved against both the company and Ahmed leading to fines, court and council costs together totalling £6500.

Redbridge Cabinet Member for Enforcement and Community Safety, Cllr Khayer Chowdhury, said: “We have zero tolerance for those who treat our borough disrespectfully, and this prosecution is testament to our commitment to holding law breakers to account for their behaviour. Everyone, including businesses with private land in the borough, have a responsibility to keep our borough tidy - it doesn’t just fall to a few of us. Redbridge is our home, and we all deserve to live in a nice, clean and tidy neighbourhood.”

All fly tips made known to the council are recorded and investigated, with enforcement action being taken if evidence is found. The council aims to clear all recorded fly-tips on council land and the highway within 24 hours of it being reported. You can also submit evidence of perpetrators or their vehicles on the Council’s Report It page which will aid enforcement investigations.
