Ilford woman who repeatedly fly-tipped rubbish in her neighbourhood brought to justice following successful court prosecution

A serial fly-tipper who repeatedly dumped rubbish on the street, just yards from her house, was brought to justice following a successful court prosecution led by Redbridge Council.

Estera Padure, from Ilford, was handed a court imposed fine and costs totalling nearly £5000 after being found guilty of five counts of fly-tipping, and breaching a Community Protection Notice (CPN) – a legally enforceable notice issued to her by Redbridge Council.

The 32-year-old was linked to five separate fly-tipping incidents in Kent View Gardens, Ilford, over a period of 6 months.

Redbridge Council’s Enforcement Team were first alerted to the fly-tips on Kent View Gardens following a public complaint.

Arriving at the scene, Enforcement Officers were confronted with a child’s pushchair, along with multiple bags of household waste and food waste liable to attract vermin, such as rats and mice, to the area.

The team quickly traced the mess back to a property in Highbury Gardens, just 50 yards away, where they discovered the property’s front garden littered with waste items similar to those found in the fly-tip they were investigating.

Further fly-tipping incidents were flagged in Kent View Gardens, all of which led back to the property in Highbury Gardens, whose occupier was identified as Padure. The investigation also revealed Padure was not using a council issued bin for the storage of her household waste.

Despite being issued a Community Protection Warning Letter giving directions for the storage and management of her household waste, and how to prevent it being unlawfully left on the street, Padure continued to break the law and fly-tip her rubbish.

Sacks of household waste, a child’s scooter, carboard boxes and a large, old paint container were among the items discovered dumped on Kent View Gardens as Padure repeatedly fly-tipped her neighbourhood, creating regular mess on the street for her neighbours. There was also evidence that she was still failing to store her waste properly at the front of her address.

Padure was subsequently issued with a legally enforceable CPN ordering her to stop fly-tipping and comply with directions given to prevent her household waste from being left on the street.

A follow up inspection check later revealed Padure’s council issued waste bin overfilled with rubbish, with other waste bags and loose rubbish on the ground, in breach of the CPN.

She was promptly issued a Fixed Penalty Notice of £100, which remained unpaid leading to Council led court action.

Padure was summonsed to attend Barkingside Magistrates Court, charged with a breach of the CPN and 5 counts of fly-tipping.

Appearing in court on Tuesday 21 November, she pleaded guilty to all charges and was fined and ordered to pay Court and council costs, including fly-tip clear up fees, totalling £4,990.     

Redbridge Cabinet Member for Enforcement and Community Safety, Cllr Khayer Chowdhury, said: “While the majority of our communities take pride in their area, there is a minority who behave in a way that brings down their neighbourhood. There is no excuse for fly-tipping, especially when we have so many ways to dispose of rubbish responsibly in Redbridge. Nobody wants to see their street turned into an eyesore or a dumping ground, which is why we won’t hesitate to take action against those committing grime crimes in our borough.”

All fly tips made known to the council are recorded and investigated, with enforcement action being taken if evidence is found. The council aims to clear all recorded fly-tips on council land and the highway within 24 hours of it being reported.
