Community right to bid

If you're a member of a community group and feel that a local property is of value to the community, then you can nominate that property as being an 'asset of community value'.  

On this page you can find out how to nominate a building or area of land to be listed on the register. This information is a summary guide to the Community Right to Bid provision.

What is Community right to bid?

The Community Right to Bid gives members of the local community the right to nominate buildings and land (assets) that you think are important to your community for listing on the Register of Assets of Community Value. 

Should the owner of the asset of community value then decide to sell the property they must tell us first.  We will then let the relevant community groups know that the owner wishes to sell the property.  The community groups then have up to 6 weeks to tell us if they want to make a bid to buy the property.  If they don't inform us that they wish to bid within the 6 week period then the owner may sell the property.

If a community decides to bid for the property they must let us know.  They have a six month period (starting from the date the owner told us they want to sell the property) to put a bid together and make an offer to the owner.  After 6 months, the owner has the option to sell to the community group, or to another party.

 

What can be nominated?

A building or land can be listed as an Asset of Community Value if it:

  • is currently being used, or was used in the last five years, for activities which improve the social well-being and interests of the local community; or
  • will continue to be used for at least the next five years for activities which improve the social well-being and interests of the local community

It could be your local:

  • Community centre
  • Shop
  • Library
  • Pub
  • Sports centre
  • Playing field

If a property is deemed as an 'asset of community value', then the owner of that property must tell us about any intention to sell the property, so that local community groups have the opportunity to make an offer to the owner to buy the property.  This does not mean that the community group has a right of first refusal to buy the property.

 

How to nominate a property

The ability to nominate a property as an asset of community value was introduced under the Localism Act 2011.  These provisions aim to prevent the loss of privately or publicly owned 'Community Assets' to the public. If your community group wish to nominate a property asset for consideration as a Community Asset you must either:

We will look at your nomination, in accordance with the regulations, to see whether the building or land qualifies to be listed as an Asset of Community Value.  If the property meets legislation requirements, it will be included on Redbridge’s 'List of Assets of Community Value'.  

 

Assets of Community Value in Redbridge

A building or land will stay on our Register of Assets of Community Value for five years. We publish this list on this page, along with the list of unsuccessful nominations.

The nomination was submitted by South Woodford Society and on the basis of the facts provided it was impossible to distinguish the different offering of the pubs to conclude that The George PH warranted listing as an Asset of Community Value and that in and of itself it furthers the social well-being of South Woodford. The Council does not consider the society has provided sufficient information and on it being eligible to nominate an asset for inclusion in the loss of Asset of Community Value.

 

The eligibility of the requirement for ACV have not been met and it is considered that the society has a connection with South Woodford but has not provided evidence in support of the nomination. It is possible that other public houses in the locality provide social well-being or social interest to the local community. It is considered that the George PH could be listed at some time in the future.

Summary of reasons Insufficient information/evidence has been provided to conclude the Railway Bell PH furthers social well-being of the local community and the lack of evidence of use by local groups or for events provided by nominator. The nomination was submitted by South Woodford Society and on the basis of the facts provided it was impossible to distinguish the different offering of the pubs to conclude that the Railway Bell PH warranted listing as an Asset of Community Value and that in and of itself it furthers the social well-being of South Woodford.

 

The Council does not consider the nominator has provided sufficient information and on it being eligible to nominate an asset for inclusion in the loss of Asset of Community Value. The eligibility of the requirement for ACV have not been met and it is considered that albeit the society has a connection with South Woodford it has not provided evidence  in support of the nomination.

 

It is possible that other public houses in South Woodford could provide social well-being or social interest to the local community. It is considered that the Railway Bell PH could be considered  for listing as an ACV sometime in the future.

It does not meet the criteria set out by the Localism Act 2011 (Part 5, Chapter 3, ss 87-102) therefore cannot be deemed an asset of community value.
