Home Energy Conservation Act

Energy Efficient HouseThe Home Energy Conservation Act 1995 requires all UK local authorities with housing responsibilities to prepare, publish and submit to the Secretary of State an energy conservation report identifying energy conservation measures, which it considers practicable, cost-effective and likely to result in a significant improvement in the energy efficiency of all residential accommodation in its area.

The Act covers all residential accommodation across all ownership and tenure. It defines residential accommodation as "premises occupied or intended to be occupied as a separate dwelling and forming the whole or part of a building". Mobile homes are specifically included.

Duties and requirements

The full list of duties and requirements of the Home Energy Conservation Act 1995 (incorporating amendments made by the Energy Conservation Act 1996) are as follows:

It is the duty of every conservation authority to prepare an energy conservation report, which shall:

  • Set out energy conservation measures that the authority considers practicable, cost-effective and likely to result in significant improvement in the energy efficiency of residential accommodation in its area (measures can include information, advice, education and promotion as well as making grants and carrying out works)
  • Include an assessment of the cost of the measures
  • Include an assessment of the extent to which emissions of carbon dioxide will be reduced as a result of the measures
  • Include a statement of any policy the authority has for taking into account the personal circumstances of any person.

An energy conservation authority shall:

  • Publish the report and send a copy to the Secretary of State
  • Prepare, publish and send to the Secretary of State reports on the progress in implementing measures set out in the energy conservation report
  • Have regard to any guidance given by the Secretary of State
  • Modify their energy conservation report or prepare further reports setting out additional or modified energy conservation measures, if so directed by the Secretary of State
